This will get ugly.
- Us Americans will learn all kinds of obscure shit that will interfere with the confirmation process.
- We also get to re-litigate Ruth Bader Ginsburgâs decision to not retire.
I donât think it will get that ugly. If the Democrats can move the process along quickly enough, they have enough votes to confirm Bidenâs eventual nominee. They just have to do it before the mid-terms.
Why I think Bidenâs nominee will have a (relatively) easy time being confirmed:
Manchin and Sinema already voted for Brown Jackson when she was appointed to the D.C. Circuit last year. Additionally, Republican Senators Lindsey Graham, Susan Collins, and Lisa Murkowski joined all 50 Democrats in voting for her circuit court nomination.
But the real reason I donât think this will be a big deal is that ultimately it doesnât matter. Even if Biden appoints the most Liberal Justice imaginable, Conservatives still hold a 6-3 majority on the Supreme Court. Any Justice Biden nominates will essentially be a lame duck for the next 25-30 years, unless something unexpected or drastic happens.
This isnât like when Scalia suddenly died and the very balance of the Court could have changed. This is about as inconsequential Supreme Court nomination as you could have.
Some very much needed good news today:
If approved, and she should be, Ketanji Brown Jackson would be the first Black Woman on the Supreme Court, the only sitting justice who worked as a public defender, and would an excellent liberal and progressive justice. Her parents worked as public school teachers, and she went to public school herself until college.
âJacksonâs work as a public defender is cause for celebration. No sitting justice has held this job, which may be one factor in the courtâs bias toward prosecutors and law enforcement. Jackson represented a range of criminal defendants, including GuantĂĄnamo Bay detainees, vindicating the constitutional rights of scorned, persecuted, and impoverished individuals. She took on these cases at great risk to her future ambitions; Republicans and conservative media have already criticized her representation of GuantĂĄnamo detainees as evidence that she is soft on terrorists. (Her brother served with the U.S. military in Iraq during this period.) Jackson remained active in public defense after rejoining Big Law, winning an award from the American Bar Association for supporting indigent Alaskansâ right to counsel. In 2010, she joined the U.S. Sentencing Commission and played a major role in shortening prison terms for many drug offenders.â
Even if Ketanji Brown Jackson will be in the Courtâs minority for the foreseeable future, she will be a great edition and her eventual confirmation should be celebrated for the historic occasion it is.
Iâm a little sad this wasnât bigger news which is understandable given world events but sheâll be a great supreme court justice.

The entire student debt forgiveness problem is now blocked due to the courts in response to a bunch of Republican lawsuits trying to undo it all.
The plan is to distribute it to all 50 states.
