Why do I imagine a scene in the White House like in The Office? “Mr. President Antifa is not a terrorist organization.” “But I DECLARED it!”
Secondly I’d argue that if being surrounded by cops, on the ground, with one officer’s knee on your NECK isn’t “in custody” then I don’t know what is. I realize the verbiage could confuse people and make them think he died in jail, but they were taking him into custody by arresting him.

the problem isn’t the use of the word “custody”, it’s the passive voice that obscures the cops’ culpability.

Sorry for another post so soon, but this is important.
Checking in from Kansas City on the protests. KCPD was out in force this weekend. They tear gassed protesters and brought out beanbag ammo. Governor declared a state of emergency. The National Guard was here. There was an 8pm curfew.
Everything is much quieter today, but I dunno if that will hold.
