Am I misremembering, or didn’t he try fighting this all the way up to the supreme court already?
This is stupid. A bunch of lawyers and judges and doj officials all spent a bunch of time while pulling salaries to settle the important question of some bullshit about who can block who on twitter.
I think you’re misremembering. If this had gone up to the Supreme Court already, the Second Circuit wouldn’t have ruled on this. I wouldn’t be surprised if this goes to the Supreme Court though.
It’s more complex than that. The underlying question is whether Trump’s use of Twitter is just some guy ranting or “official government business.”
“The First Amendment prohibits an official who uses a social media account for government purposes from excluding people from an “otherwise open online dialogue” because they say things the official disagrees with, he wrote.”
Trump’s argument was that his use of social media did not constitute “government purpose.” This decision says it is. Like I wrote above, ultimately, the Supreme Court will probably decide this.
Yeah I guess I was remembering the first ruling from 2018. This felt squarely in the “you could have that argument, if you didn’t do these things” kind of thing.

Just watched the trump citizenship question on the census thing. Sounds like they’re dropping the question, but he’s attempting to intimidate non citizens to not fill it out with all his comments and his “executive order”.
Congressional Democrats sued Trump for the same reasons and that case is still ongoing:
“A similar case, filed by congressional Democrats, is now before the United States Court of Appeals for the District of Columbia Circuit, and legal experts say the question could well wind up before the Supreme Court.”
